These Terms and Conditions (the "Terms") govern your access to and use of the Kawze uptime monitoring service, including our website, dashboard, API, and any related monitoring, alerting, and status page features (together, the "Service"). The Service is provided by Peterbrook Trading Ltd, trading as Kawze, a company registered in England and Wales under company number 15540069, with its registered address at Peterbrook Close, Redditch, B98 7YF, United Kingdom ("Kawze", "we", "us", or "our").

By creating a Kawze account or otherwise using the Service, you agree to be bound by these Terms, along with our Privacy Policy, Data Retention Policy, Trademark Notice, and, where applicable, our GDPR Data Processing Agreement (together, the "Agreement"). If you do not agree to these Terms, you must not use the Service.

1. What Kawze provides

Kawze is an uptime monitoring and website monitoring service. You configure "monitors" against endpoints you own or control, and our infrastructure performs automated HTTP endpoint monitoring on a schedule you choose, checking that your site or service responds as expected. When a check fails, Kawze can notify designated contacts by email or SMS, track incidents on a timeline, and - on applicable plans - display uptime data on a public status page.

Supported monitoring capabilities include all standard HTTP methods (GET, POST, PUT, PATCH, DELETE, HEAD), HTTP status code validation, and custom request headers, available on every plan tier. What differs between tiers is scale - check frequency, number of monitors, log retention, and included SMS credit - not functionality.

2. Account tiers and plans

This table is generated directly from our tier configuration, so it always reflects what's actually enforced at signup and billing. Team members are unlimited on every tier. Where we increase pricing, we will give existing customers reasonable advance notice before the change applies to their account.

3. Your account

You're responsible for maintaining the security of your Kawze account, including your password and any API keys, and for all activity that occurs under your account. You must provide accurate account information and keep it up to date, and you must notify us promptly at [email protected] if you become aware of any unauthorised use of your account.

You may only maintain one Free tier account per individual or organisation. We reserve the right to suspend or terminate accounts used to circumvent this restriction or otherwise abuse our uptime monitoring service.

4. Acceptable use

Kawze's website monitoring and HTTP endpoint monitoring features exist to help you monitor your own websites, APIs, and services, or infrastructure you have permission to monitor. You agree that you will:

  • only configure monitors against endpoints you own, operate, or have explicit permission to monitor;
  • not use Kawze to monitor, probe, or generate load against third-party systems without authorisation;
  • not use the Service to "keep alive" a website, application, or bot in a manner inconsistent with genuine uptime monitoring;
  • not resell, white-label, or redistribute the Service, our monitoring data, or our status pages without our prior written consent;
  • never configure a monitor against an endpoint you do not own, operate, or have explicit permission to monitor while impersonating a trusted third-party identity - for example, setting a custom User-Agent to present monitoring traffic as Googlebot or another search engine, crawler, or service - in order to evade that endpoint's bot-blocking, rate-limiting, or access controls, or to otherwise disguise the true origin or purpose of the request; and
  • not use the Service in any way that is unlawful, disproportionate, or that causes harm to Kawze, other customers, or third parties.

Requests made by our monitoring infrastructure identify themselves via a dedicated User-Agent string; details for site owners on our end are published at /uptime-bot. We may suspend or terminate monitors or accounts that breach this section, or that place disproportionate load on our monitoring infrastructure relative to their plan.

5. Billing, renewal, and refunds

Paid tiers are billed monthly or annually in advance and renew automatically at the end of each billing period unless cancelled beforehand. Additional SMS credits may be purchased separately and do not expire once purchased. If you change your mind about an SMS credit purchase, you can request a full refund within 14 days of the purchase date, provided none of the credits from that purchase have been used yet; see our Refund Policy for full details.

If you are a consumer contracting with us from the UK or EU, you have a statutory right to withdraw from a paid subscription within fourteen (14) calendar days of purchase without giving a reason, in accordance with the Consumer Contracts Regulations. This withdrawal right does not apply once you have knowingly begun using paid features with your express consent before the fourteen-day period ends.

In addition to that statutory right, we also offer a voluntary 30-day money-back guarantee: if this is the first time your account has ever been billed for a paid plan, you can request a full refund within 30 days of that first billing date from the Billing page in your account dashboard, and we will refund the payment and downgrade your account to the Free tier. This guarantee applies once per account, counted from the account's first ever billing cycle rather than the start of any later subscription, and does not apply again once used. Outside of the 30-day guarantee and the statutory withdrawal period above, subscription fees are non-refundable, including where you cancel, downgrade, or under-use your plan; you will continue to have access to your paid tier until the end of the current billing period.

You can cancel a paid subscription at any time from your account settings. We reserve the right to change our pricing, and will give notice of any price increase before it applies to your next renewal.

6. Service availability and disclaimers

We work hard to keep our uptime monitoring service reliable, but Kawze is provided on an "as is" and "as available" basis. We do not guarantee that monitoring checks will be uninterrupted, that alerts will always be delivered without delay, or that the Service will detect every instance of downtime affecting your monitored endpoints. You remain responsible for maintaining your own independent visibility into the health of your systems.

7. Limitation of liability

To the maximum extent permitted by law, Kawze's total liability arising out of or relating to these Terms, whether in contract, tort, or otherwise, is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits, lost business, or lost data, arising from your use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud.

Without limiting the foregoing, and to the maximum extent permitted by law, Kawze shall not be liable to you for any loss or damage, whether direct or indirect, arising from or in connection with: (a) any failure, delay, or inaccuracy in a monitoring check performed by the Service; (b) any failure to detect that a monitored endpoint is down, degraded, or otherwise not responding as expected; (c) any failure, delay, or error in the delivery of an alert notification, whether by email, SMS, webhook, or any other channel; or (d) any downstream business impact resulting from (a) to (c), including lost revenue, lost customers, lost data, or reputational harm. You acknowledge that uptime monitoring is inherently probabilistic - checks run at intervals, not continuously - and that no monitoring service, including Kawze, can guarantee the instantaneous or complete detection of every outage or the uninterrupted delivery of every alert. Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited under English law, including liability for death or personal injury caused by negligence, for fraud, or for breach of the terms implied by the Consumer Rights Act 2015 where you are contracting as a consumer.

8. Intellectual property

Kawze and the Kawze logo are our trademarks. We retain all rights, title, and interest in the Service, including our monitoring software, dashboard, and status page infrastructure. You retain ownership of the data you submit to configure your monitors and of your monitoring results ("Customer Data"). We may use aggregated and anonymised data derived from use of the Service to improve our uptime monitoring product, provided it cannot be used to identify you or your monitored endpoints.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account, with or without notice, if you materially breach these Terms, including the acceptable use provisions in Section 4, or if required to do so by law. On termination, your right to access the Service ends, subject to the data retention and deletion terms set out in our Data Retention Policy.

We also reserve the right, at our discretion, to close or block an account and suspend access to the Service where we reasonably consider it necessary - for example, to prevent abuse, fraud, or a breach of these Terms, or to comply with a legal or regulatory obligation. This discretionary right does not affect any statutory rights you have as a consumer, and any refund you are legally entitled to will still be issued in accordance with Section 5 and our Refund Policy.

10. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service or legal requirements. Where changes are material, we will notify active customers by email or via an in-app notice before they take effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute arising out of or in connection with these Terms or the Service.
